Infringement


In Costa Rica there is an Enforcement Law that enables us to perform several actions against the sale, storage and exhibition of fraudulent products. These actions are the following:
1. Criminal Accusation before the District Attorney: This action comprises in filing a fully documented accusation against the person or company who is infringing trademarks rights, specifically in trademark falsification, and in the sale, storage and distribution of fraudulent products.
2. Precautionary border measures, before or after the product enters Costa Rica: This action takes place before the General Customs Director and the Fiscal Police, in order to seize the merchandise at any of the eight customs posts of our country.
3. Civil precautionary measures: If the merchandise is already in the Costa Rican market and there is no relationship with tax infringement, civil actions must be carried out to request the seizure of the merchandise.
4. Civil actions due to unfair competition and trademark infringement: This type of action can be filed before the Costa Rican civil courts based on unfair competition.
