Unfair Competition

Civil actions due to unfair competition and trademark infringement: This type of actions can be filed before the Costa Rican Civil Courts based on unfair competition.  According to the Enforcement Law, unfair competition is ”every conduct that reproduces without the owner’s authorization, trademarks and other protected elements in benefit of its lawful owner, to take advantage in a commercial scale of the results of the efforts and prestige of others” and “any use of trademarks that cannot be registered due to its similarities with registered marks”.
